Terms of use
These terms apply when you use the Mallow app or mallow.care. They’re an agreement between you and us, the makers of Mallow. Please read them; by using Mallow you agree to them. Nothing in them takes away rights the law gives you as a consumer.
Who we are
Mallow is made by Northbound (“we”, “us”), a sole proprietorship (eenmanszaak) in Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 99692260. You can reach us at hello@mallow.care. Our privacy policy explains how we handle personal data.
What Mallow is, and isn’t
Mallow is a bedtime game: a duck that only falls asleep when your phone does. It can help you build a better evening routine. It is not a medical device and doesn’t give medical advice. Mallow is a duck, not a doctor: if you have trouble sleeping or feel unwell, talk to a doctor.
Putting apps to sleep is a helper, not a lock. It uses your phone’s own tools (Screen Time on iPhone, the accessibility service on Android). Some phones don’t allow it, it can’t cover every app or situation, and you can always wake Mallow early or switch it off. Calls, alarms and emergency calls keep working. Don’t rely on Mallow to keep you from anything that matters for your health or safety.
Using Mallow
You may use Mallow if you’re old enough to agree to these terms where you live. If you’re not, ask a parent or guardian to agree to them for you. Use Mallow for yourself, not for anyone else’s phone without their permission, and don’t use it in a way that breaks the law or harms Mallow or other people.
Mallow Plus
After onboarding, Mallow needs Mallow Plus, an auto-renewing subscription, yearly or monthly. The price, including VAT, is shown in the app and by the store before you buy.
- Free week. The yearly plan may start with a free trial for people who haven’t had one. If you don’t cancel at least 24 hours before the trial ends, it turns into a paid subscription. Any unused part of a free trial ends when you buy a subscription.
- Payment. You buy and pay through the App Store or Google Play. Payment is charged to your Apple ID or Google account when you confirm the purchase, or when the free trial ends.
- Renewal. Your subscription renews automatically for the same period unless you cancel it at least 24 hours before the current period ends. Your account is charged for the renewal within the 24 hours before the period ends.
- Cancelling. Manage or cancel your subscription at any time in your App Store or Google Play account settings. Deleting the app doesn’t cancel it. After you cancel, Mallow Plus stays on until the end of the period you paid for.
- Refunds. Apple and Google handle payments and refunds for purchases in their stores, under their own rules. If something went wrong, write to us too, and we’ll help where we can.
- Price changes. If the price changes, the store tells you beforehand, as its rules require, and you can cancel before the new price applies.
- Right of withdrawal. If you live in the European Union or the United Kingdom, you may have the right to withdraw from a purchase within 14 days. Purchases are made through Apple or Google, so withdrawal requests go through them.
Stars, looks and other game items
Stars, levels, dreams, streaks, freezes, hats, blankets, rooms, shelf treasures and other things you earn in Mallow are part of the game. They have no money value, can’t be bought, sold or exchanged for money, and aren’t your property. We may adjust how the game works, for example how many stars something costs.
Mallow saves your game on your phone only. Your phone’s own backup (iCloud or Google) can bring it to a new phone of the same kind. Without a backup, if you delete the app, reset your phone or lose it, your game may be lost, and we can’t bring it back.
Your licence
We give you a personal, non-exclusive, non-transferable licence to use the Mallow app on devices that you own or control, for your own non-commercial use, under these terms and the store’s usage rules. You may not copy, sell, rent or share the app; change it; copy its contents; or take it apart or get around its protections, except where the law allows that anyway.
What’s ours
Mallow’s name, the duck, its drawings and animations, the dreams, the looks, the text and the software are ours or licensed to us, and are protected by intellectual property laws. These terms don’t give you any rights to them beyond the licence above.
If you send us ideas or feedback, thank you. We may use them freely, without owing you anything.
Changes
We keep improving Mallow, so features may change or come and go. We may also update these terms. If a change matters to you, we’ll tell you in the app or on this website before it applies. If you don’t agree with new terms, you can stop using Mallow and cancel your subscription.
Our responsibility
We work hard to make Mallow good and reliable, and you have the legal guarantees that consumer law gives you for apps and digital services. Beyond those, we can’t promise that Mallow will always work without interruption or errors, or on every phone.
We are responsible for damage we cause intentionally or through gross negligence, and for anything else the law doesn’t allow us to exclude, such as death or personal injury caused by our negligence. Otherwise, as far as the law allows, we aren’t responsible for indirect damage (such as lost data or lost profit), and our total responsibility is limited to the amount you paid for Mallow Plus in the twelve months before the damage happened.
Ending
You can stop using Mallow at any time: cancel your subscription in your store account and delete the app. We may end your licence if you seriously break these terms, after telling you, unless the law or safety requires us to act at once.
If you got Mallow from Apple’s App Store
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the Mallow app and its content.
- Your licence is limited to using the app on Apple-branded products that you own or control, as allowed by the usage rules in the App Store’s terms of service. Family Sharing may let other members of your family use it as those rules allow.
- We alone are responsible for maintaining and supporting the app. Apple has no obligation at all to do so.
- If the app doesn’t conform to a warranty that applies to it, you may tell Apple, and Apple will refund the purchase price for the app (if any). To the extent the law allows, Apple has no other warranty obligation for the app; any other claims, losses, liabilities, damages, costs or expenses caused by a failure to conform to a warranty are our responsibility under these terms.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that the app or your use of it infringes their intellectual property rights, we, not Apple, are responsible for the investigation, defence, settlement and discharge of that claim.
- You confirm that you are not located in a country that is subject to a United States government embargo or that the United States government has designated as “terrorist supporting”, and that you are not on any United States government list of prohibited or restricted parties.
- Questions, complaints or claims about the app go to us: Northbound, Amsterdam, the Netherlands, hello@mallow.care.
- When you use the app, you must also follow any third-party terms that apply, such as your mobile carrier’s.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right (and is deemed to have accepted it) to enforce them against you as a third-party beneficiary.
If you got Mallow from Google Play
Google isn’t a party to these terms and isn’t responsible for the app. Your purchases through Google Play are also governed by Google Play’s own terms.
Law and disputes
Dutch law applies to these terms. If you’re a consumer living in another country, you also keep the protection of the mandatory laws of that country. If you have a complaint, please write to us first: most things are solved quickly that way. If we can’t solve it together, the competent court in the Netherlands can decide, or, if you’re a consumer, the courts where you live.
If a part of these terms turns out to be invalid, the rest still applies. If we don’t enforce a part straight away, we haven’t given it up.
